| The Customs Law
The Customs Law of the Republic of Latvia took effect into force on March 18, 2004. The Law, in particular, introduced the definition "counterfeit and piracy goods" (Article 114) and determined the order on customs control measures in the field of intellectual property protection, which was realized by creating a special document named "The Regulations of customs control measures on intellectual property protection" (hereinafter, The Regulations) which took effect on July 01, 1999, and was meant to prevent importation and exportation of counterfeit goods. In July 2001 The Regulations lost its force, and instead of that the new updated document, named "The Order on Customs Control Measures in the field of Intellectual Property Protection"( hereuinafter, The Order) took effect on July 28, 2001.
"The Order", being in fact the by-law, determines the concrete order to carry out the measures to protect the intellectual property by interdiction of free circulation of counterfeit and piracy goods including preventing exportation and importation of these goods, besides "The Order" provides a detailed instruction on filing a request to the Customs Department in case of intellectual property infringement, determine which documents should be filed, which checking measures may be organized and, at last, which actions are acceptable in case of infringement.
